Section 1 Scope and incorporation
(1) These General Terms and Conditions ("GTC") apply to all contracts of sale for goods that Loop24 Stores GmbH ("LooP24") sells to its customers ("Customer") at its store at Breite Gasse 7, 71032 Böblingen, either via vending machines or by taking goods from the shelf and paying at the self-checkout terminal.
(2) The GTC become part of the contract of sale by being displayed clearly and visibly at the place where the contract is concluded — at every vending machine and at the self-checkout terminal — so that the Customer can take reasonable notice of them before purchasing (Section 305 (2) German Civil Code, BGB). Publication at loop24-stores.de/agb serves as additional information only.
(3) Conduct inside the store is not governed by these GTC but by the house rules displayed on site. Those house rules apply by virtue of the owner's domiciliary right (Sections 858, 903, 1004 BGB) to everyone entering the store, whether or not a purchase is made.
(4) Deviating terms of the Customer do not become part of the contract.

Section 3 Conclusion of contract, handover, no right of withdrawal
(1) The display of goods in the vending machines and on the shelves is not a binding offer but an invitation to the Customer to make an offer.
(2) When purchasing from a vending machine, the contract of sale is concluded when the Customer selects the goods, pays the purchase price and the machine dispenses the goods into the delivery compartment.
(3) When purchasing from the shelf, the contract of sale is concluded when the Customer scans the goods at the self-checkout terminal and pays the purchase price. Title to the goods passes upon payment in full.
(4) The purchase takes place at a vending machine or in automated business premises. There is therefore no right of withdrawal (Section 312 (2) no. 9 BGB). Statutory rights in respect of defects (Section 8) remain unaffected.
Section 4 Prices and payment
(1) The prices displayed at the vending machine, on the shelf or at the terminal at the time the contract is concluded apply. All prices are final prices in euros and include statutory VAT.
(2) Deposit amounts for beverage packaging are not included in the price. In accordance with Section 7 of the German Price Indication Ordinance (PAngV) they are shown separately in addition to the price and charged on top at the time of purchase.
(3) Payment is made exclusively cashless and immediately before the goods are dispensed, using the payment methods displayed on the respective device (e.g. debit card, credit card, contactless card and mobile payment). Cash is not accepted anywhere in the store; neither the vending machines nor the self-checkout terminal have any cash acceptance function.
(4) We ask the Customer to check the payment receipt or payment confirmation after the purchase. If the amount debited differs from the price displayed, a notification via one of the channels named in Section 7 (2) is sufficient. A later notification does not result in any loss of rights.
Section 5 Protection of minors and age verification
(1) Age-restricted goods are dispensed only after successful age verification.
(2) The statutory age limits apply: beer, wine, wine-like beverages and sparkling wine, as well as mixtures thereof, are dispensed only to persons aged 16 and over (Section 9 (1) no. 1 of the German Protection of Young Persons Act, JuSchG). Other alcoholic beverages, in particular spirits and foodstuffs and mixed drinks containing spirits, are dispensed only to persons aged 18 and over (Section 9 (1) no. 2 JuSchG). Tobacco products, other nicotine-containing products and their containers, and — pursuant to Section 10 (4) JuSchG — also nicotine-free electronic cigarettes, electronic shishas and their containers, are dispensed only to persons aged 18 and over (Section 10 (1) JuSchG).
(3) Age verification takes place at the age verification terminal by electronically reading an official identity document and matching it against the person present. Without successful age verification, no contract of sale is concluded for age-restricted goods.
(4) The Customer must not pass on age-restricted goods to children or adolescents who have not reached the relevant minimum age.
(5) Where there are justified doubts as to identity or age, the sale may be refused.
(6) If age verification is technically unavailable, the sale of all age-restricted goods is automatically blocked until verification is operational again (Section 9 (3), Section 10 (2) JuSchG).
(7) Details of the processing of data collected during age verification are set out in the data protection notice displayed in the store.
Section 6 Retention of title, removal of goods without payment
Goods remain the property of LooP24 until paid for in full. Removing or taking away goods without paying in full — for example by manipulating a vending machine, bypassing the self-checkout terminal, or taking goods from an open or malfunctioning dispenser — is a criminal offence and will consistently be reported to the police (depending on the circumstances, in particular Sections 242, 246, 263a of the German Criminal Code). Civil law claims remain unaffected.
Section 7 Malfunctions during dispensing, refunds
(1) If, despite successful payment, no goods or not the selected goods are dispensed, the Customer may withdraw from the contract and demand a refund of the amount paid. At the Customer's request we will supply the goods subsequently instead.
(2) We ask the Customer to report any malfunction as promptly as possible — via the help button at the self-checkout terminal or at info@loop24-stores.de. Such a report is not a precondition for the claim; it merely helps us to issue the refund more quickly. Date, time, machine number and receipt or transaction number are helpful.
(3) To process the matter quickly, we compare the report with the device's transaction and dispensing log. The Customer's claim does not depend on the Customer proving the malfunction.
(4) Refunds are made without undue delay via the original method of payment.
Section 8 Rights in respect of defects
The statutory rights in respect of defects apply (Sections 434 et seq. BGB). For food products, please observe the best-before or use-by date printed on the packaging. Complaints can be submitted via the channels named in Section 7 (2).
Section 9 Liability
(1) LooP24 is liable without limitation for damage arising from injury to life, body or health based on a breach of duty by LooP24, its legal representatives or vicarious agents; further for intent and gross negligence, for fraudulently concealed defects, within the scope of a guarantee assumed, and under the German Product Liability Act.
(2) In the case of slightly negligent breach of a material contractual obligation — an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance the Customer may regularly rely — liability is limited to the foreseeable damage typical for this type of contract.
(3) Liability is otherwise excluded.
(4) LooP24 assumes no safekeeping or custodial duty for items brought in or left behind by the Customer (e.g. mobile phones, wallets, clothing). Paragraphs 1 and 2 remain unaffected.
(5) The Customer is liable under the statutory provisions for damage caused by the Customer to vending machines, fixtures or goods.
Section 10 Take-back of deposits, packaging and waste equipment
(1) We take back deposit-bearing single-use and reusable beverage packaging of the type we sell, within the scope of the statutory requirements. The take-back point and times are displayed in the store.
(2) Waste electrical and electronic equipment, in particular used disposable e-cigarettes, must not be placed in residual waste. We take such items back free of charge in accordance with the German Electrical and Electronic Equipment Act (ElektroG); the collection point is marked in the store.
Section 11 Hot food dispensing
Meals from the hot food vending machine are dispensed ready to eat and hot. Container and contents may be very hot; there is a risk of scalding. Please remove the meal carefully, let it cool before eating and supervise children. The notices on the machine and on the packaging must be observed.
Section 12 House rules, video surveillance and data protection
(1) The house rules displayed in the store apply. They are not part of the contract of sale but an exercise of the owner's domiciliary right, and they apply to everyone present.
(2) The store is subject to video surveillance for the purpose of exercising the domiciliary right and of preventing and investigating criminal offences. Information pursuant to Art. 13 GDPR is provided by the signs at the entrance and by the data protection notice displayed in the store, which also states the controller, the retention period, recipients and the rights of data subjects.
(3) In all other respects, the data protection notice displayed in the store and the privacy policy at loop24-stores.de apply.
Section 13 Final provisions
(1) The law of the Federal Republic of Germany applies. If the Customer is habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected (Art. 6 (2) Rome I Regulation).
(2) If any provision of these GTC is invalid, the remainder of the contract remains effective. The statutory provisions take the place of the invalid provision (Section 306 (2) BGB).
